Terms and Conditions

1. Description of services

DataSeam (Pty) Ltd (“DataSeam”, “we”, “our”, “us”) is a managed data and business intelligence service based in South Africa. We connect a client’s existing business systems (accounting, e-commerce, point-of-sale, and similar platforms) into automated data pipelines and live Power BI dashboards, and we monitor and maintain that infrastructure on an ongoing basis. Our service also includes Answers, a plain-English chat that lets clients ask questions about their own reporting data and receive written responses. Answers operates on a read-only basis and does not use client data to train AI models; it is described further in our Privacy Policy.

2. Onboarding and delivery

Subject to availability and receipt of payment, onboarding typically follows a four-week build process: discovery, data source connection and pipeline build, and dashboard delivery. Once delivered and accepted, dashboards are refreshed daily, access is provided via Microsoft Power BI, and the Answers chat is activated over your reporting data. Specific scope, timelines, and deliverables for each engagement are set out in the client’s signed Client Services Agreement.

3. Who we work with

Our services are offered to businesses based in South Africa.

4. Cancellation and refund policy

Engagements run on a 3-month minimum term, after which they continue month-to-month with 30 days’ written notice required to cancel.

• The once-off onboarding fee is non-refundable once work has commenced.
• Monthly retainer fees already paid for the current billing period are non-refundable, but no further fees are charged once a cancellation notice period has run.
• On cancellation, we provide a full export of your data — raw data and reporting layers — in CSV or SQL format within 14 days. All data is permanently deleted from our Azure environment 30 days after cancellation, with written confirmation provided. Your data is always yours.

5. Privacy

We take reasonable steps to protect the personal information of clients and website users in line with the Protection of Personal Information Act, 2013 (POPIA). Full detail is set out in our Privacy Policy.

6. Payment options accepted

Payment for our services may be made by card (Visa, Mastercard) via Payfast, or by direct bank transfer (EFT) into the DataSeam (Pty) Ltd bank account, details of which are provided on your invoice or on request.

7. Card acquiring and security

Card transactions are acquired for DataSeam via Payfast, an approved payment gateway for all South African acquiring banks. Payfast uses Secure Socket Layer (SSL) encryption, and no card details are stored on this website. You can view Payfast’s security certificate and security policy at payfast.io.

8. Customer details held separately from card details

Your contact and account details are stored by DataSeam separately from your card details, which are entered directly on Payfast’s secure site and never pass through or are stored on our servers.

9. Merchant outlet country and transaction currency

The merchant outlet country at the time of presenting payment options is South Africa. The transaction currency is South African Rand (ZAR).

10. Responsibility

DataSeam takes responsibility for all aspects of the services described on this website, including service delivery, customer support, and dispute resolution.

11. Governing law and domicile

This website and these terms are governed by the laws of South Africa. DataSeam (Pty) Ltd chooses as its domicilium citandi et executandi — for all purposes including legal notices and process — 50 Jennings Street, Strand, Western Cape, South Africa.

12. Changes to these terms

We may update these Terms and Conditions from time to time to reflect changes to our services or legal requirements. The “last updated” date at the top of this page reflects the most recent revision. Continued use of our website or services after a change takes effect constitutes acceptance of the updated terms.
